Introduction

Welcome to Novion Media, LLC's website. By using our services, you agree to comply with and be bound by the following terms and conditions. Please review them carefully. We will notify clients of any updates to these Terms of Service via our website or by email.

Service Provision

Novion Media, LLC offers real estate photography services, including but not limited to photography, videography, drone footage, 3D virtual tours, and other add-on services as detailed on our website. Services are subject to availability, and Novion Media, LLC reserves the right to refuse service at its discretion.

Scheduling and Cancelation Policy

To ensure efficient scheduling and resource allocation, Novion Media, LLC requires at least 24 hours’ notice for any changes or cancellations to scheduled appointments. Changes or cancellations made with less than 24 hours’ notice may incur a cancellation fee of $200 to cover preparation costs, travel expenses, and missed business opportunities. Failure to pay the cancellation fee may result in withheld delivery of any media. Rescheduling requests are subject to availability and may be accommodated without additional fees if made with at least 24 hours’ notice. This policy applies to all services, including but not limited to photography, videography, drone footage, and 3D virtual tours. Novion Media, LLC reserves the right to apply this fee at its discretion and will notify clients in advance if the fee is to be applied.

Payment

Payment can be made via card, check, or cash. Payment is due at the time of service, upon delivery of the final product, or via online portal. Novion Media, LLC reserves the right to withhold delivery of the media until full payment is received. Novion Media, LLC reserves the right to refuse future services to clients with outstanding unpaid invoices.

Turnaround Time

Turnaround times are as described in our Post-Shoot Guide. For photos, drone imagery, Matterport, virtual staging, and floor plans, we aim to deliver within 48 hours for services conducted Monday through Saturday, excluding Sundays. For video services, we aim to deliver within 72 hours for services conducted Monday through Saturday, excluding Sundays. These turnaround times are estimates and not guarantees. We will make every effort to meet these timelines and will notify clients promptly of any delays due to unforeseen circumstances.

Intellectual Property and Licensing

Upon receipt of full payment, Novion Media, LLC grants the client a non-exclusive, non-transferable license to use the images, videos, and/or virtual tours (collectively, "Media") for a period of six (6) months from the invoice date or until the property listed on the invoice is sold, terminated, or otherwise removed from active marketing, whichever occurs first. This license is specific to the individual or company listed on the invoice and is valid solely for marketing the property described on the invoice.

Ownership of all Media produced by Novion Media, LLC remains with Novion Media, LLC. The license granted upon payment does not transfer or convey ownership or copyright to the client.

The client may not transfer or sell this license to a third party without the explicit written consent of Novion Media, LLC.

Upon expiration or termination of the license, Novion Media, LLC may archive the Media, including but not limited to Matterport tours and other digital assets, on its own storage systems at its discretion.

Novion Media, LLC reserves the right to use any Media produced for promotional purposes, including but not limited to use in portfolios, advertising materials, and social media platforms.

Pricing for Additional Structures
Our pricing is based on the square footage of the main home, as provided by the client. Additional structures, such as shops, DADUs, or garages, are charged at 50% of the standard per-square-foot rate (see Pricing page for rates). If undisclosed structures are discovered on-site, they will be added to the invoice at this rate. Properties with large lots, wooded areas, or unique features (e.g., extensive landscaping, water features, or complex structures) may incur an additional fee of $75–$150 for extra time or effort. Novion Media, LLC will make reasonable efforts to notify clients of additional fees before they are applied. Clients are responsible for providing accurate property details during booking to ensure correct pricing.

Limitation of Liability

Novion Media, LLC shall not be liable for any loss or damage to property or persons during the course of the photo shoot, except in the case of willful negligence or misconduct by Novion Media, LLC. Novion Media, LLC’s total liability for any claim, loss, damage, or injury arising under or relating to this Agreement shall be limited to the amount paid by the Client to Novion Media, LLC under this Agreement. Novion Media, LLC shall not be liable for any indirect, consequential, or incidental damages, including but not limited to lost profits or business opportunities.

Client Responsibilities

Clients are responsible for ensuring the property is accessible, safe, and prepared for the scheduled services. This includes but is not limited to clearing clutter, ensuring proper lighting, and providing access to all areas to be photographed or filmed. Novion Media, LLC is not responsible for delays or additional costs caused by unprepared properties.

Force Majeure

Novion Media, LLC shall not be liable for any failure or delay in performing services due to circumstances beyond its reasonable control, including but not limited to natural disasters, equipment failure, or other unforeseen events.

Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Washington. Any disputes arising under or relating to these Terms shall be resolved in the state or federal courts located in Lewis County, Washington, and both parties consent to the jurisdiction of such courts.
 

Changes to Terms

Novion Media, LLC reserves the right to update or modify these Terms of Service at any time. Changes will be communicated to clients via our website or by email and will take effect immediately upon posting or as specified in the notification.
